The present modification has been filed for modification of order dated 17.07.2018 passed in Cr. Misc. No. 41102 of 2018 by which, the petitioners were granted the privilege of anticipatory bail and they were directed to surrender before the Court below within a period of six weeks for furnishing bail bonds. However, it has been submitted by learned counsel for the petitioners that the petitioners could not surrender within the time as they were in Gujarat and had no know knowledge about the order.
Considering the aforesaid facts, I am not inclined to interfere with the order dated 17.07.2018 passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.64324 of 2018 (2) dt.31-10-2018 41102 of 2018 rather this application is disposed of with direction to the petitioners to surrender before the court below and pray for regular bail and if any such application is filed, the court below shall consider the same on the ground that earlier the petitioner has been granted privilege of anticipatory bail and dispose of the prayer for bail of the petitioners, if possible on same day.
