The petitioner being the husband, apprehends his arrest in connection with Complaint Case No. 1880C/2018 registered for the offence punishable under Sections 498(A) of the IPC and Section 4 of the D.P. Act.

Learned counsel for the petitioner submits that the entire allegations are false and frivolous and there is a delay of one year in lodging the present complaint. He further submits that even as on date, the petitioner is willing to keep his wife with all honour and dignity and that there shall be no recurrence for any such act which would cause mental torture to her in

Patna High Court CR. MISC. No.75128 of 2019(2) dt.02-12-2019 2/2 future. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Complaint Case No. 1880C/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. It is, however, made clear that if there is any recurrence of any untoward act leading to mental torture to the complainant, it shall be open to her to move this Court for cancellation of bail bonds.
