Petitioners seek bail in a case registered for the offence punishable under Sections 30(a) and 38(i)(ii) of the Bihar Prohibition and Excise Act, 2016.
14.250 litres of foreign liquor is said to have been recovered from the house of Vikash Kumar.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious physical possession of the petitioners. They have no concern with the seized liquor. Aforesaid house is joint family house and is inhabited by several family members of the
Patna High Court CR. MISC. No.73941 of 2019(2) dt.11-12-2019 2/2 petitioners and Vikash Kumar and they had no knowledge of keeping of the said liquor in the house by someone. Petitioners have no criminal antecedent and have been languishing in custody since 05.10.2019.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No. 8830 of 2019 arising out of Patliputra P.S. Case No. 453 of 2019.
