The petitioner seeks bail in anticipation of his arrest in connection with Gaya Mofassil P. S. Case No. 276 of 2014 dated 13.06.2014 instituted for the offences under Sections 147, 148, 149, 323, 324, 337, 307, 222, 224, 353, 379 and 504 of the Indian Penal Code.

The allegation against the petitioner is that he along with 8 to 10 persons was committing theft of coal and filling up the same in a bag. When police chased them, about 100-150 persons, armed with stones, lathi and iron rod assembled there and assaulted the police personnel. Learned advocate appearing for the petitioner has submitted that the petitioner is not named in the F.I.R. and

Patna High Court Cr.Misc. No.64076 of 2018(2) dt.14-12-2018 2/2 the name of the petitioner surfaced on the confessional statement of a co-accused Jogi Manjhi.

Learned counsel for the petitioner has further submitted that under similar circumstances one of the accused persons has been granted bail.

The petitioner does not have any criminal antecedents.

Considering the aforesaid fact, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Mofassil P. S. Case No. 276 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
