Petitioner apprehends his arrest in a case registered under Section 414/34 of the I.P.C.

Informant who is the police officer has alleged that during vehicle checking on 04.03.2016 one miscreant riding on motorcycle was stopped but he failed to produce any ownership documents of the motorcycle who disclosed his name as Awadhesh Yadav and he stated that he had purchased this motorcycle from petitioner.

It has been submitted on behalf of petitioner that neither he was apprehended with the stolen motorcycle nor same was recovered from his house and only on the statement of apprehended persons he has been falsely implicated in this case.

No.74094 of 2019(2) dt.21-01-2020 2/2 Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Dumariya P.S. Case No. 17 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
