1. Heard Shri Jitendra Prasad Singh, learned Senior Counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 324(4), 132, 351(2) and 3(5) of the BNS.

3. Learned Senior Counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he raided the river bed for apprehending illegal sand miners when the team was attacked by the accused persons causing injury and the accused were identified by the local persons, Chawkidar and by the officials of Bihta Police Station.

4. Learned Senior Counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that similarly situated co-accused, namely, Alok Kumar along with eleven others had moved before this

Patna High Court CR. MISC. No.79881 of 2025(2) dt.08-12-2025 2/2 Court seeking anticipatory bail by filing Cr. Misc. No. 78313 of 2025 and the same came to be allowed by an order dated 03.12.2025 passed by a learned Coordinate Bench of this Court, thus, the petitioner based on parity seeks anticipatory bail.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned Senior Counsel for the petitioner and taking into consideration the order dated 03.12.2025 passed in Cr. Misc. No. 78313 of 2025, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Bihta P.S. Case No. 667 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.

7. One of the bailors of the petitioner shall be his father, namely, Ganesh Yadav.
