2. This is the second attempt of the bail of the petitioner. Earlier the prayer of the anticipatory bail of the petitioner was rejected vide order dated 18.08.2023 passed in Cr. Miscellaneous No. 50819 of 2023
3. The petitioner seeks regular bail in connection with Navinagar P.S. Case No. 27 of 2023, G.R. No. 126 of 2023, registered for the offence under Section 302 of the Indian Penal Code and section 27 of the Arms Act.
4. As per F.I.R., this petitioner is alleged to have shot dead the husband of the informant.
5. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.84193 of 2024(2) dt.14-02-2025 2/2 petitioner is innocent and has falsely been implicated in this case. He further submits that the informant wanted to grab the land of the petitioner. Petitioner is residing in Chhatisgarh Bazar and earning his livelihood. At the time of occurrence i.e. on 16.01.2023, petitioner was not present on place of occurrence. During course of investigation, it has come that on the alleged date of occurrence, this petitioner was on the Navinagar Railway Station. He further submits that during pendency of this case, informant has solemnized second marriage. Petitioner is in custody since 09.09.2024. Petitioner has one criminal antecedent and he is on bail on that case.
6. Learned A.P.P. has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner is the sole assailant of the deceased.
7. Considering the nature of accusation against this petitioner, this application is dismissed.
