JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Tarabari P.S. Case No. 111 of 2019 registered for the offences punishable under Sections 341, 323, 324, 326, 307, 379, 504 and 506/34 of the Indian Penal Code. As per FIR there is allegation against petitioner No.1 that he assaulted the informant by means of knife, causing injury on his hand, petitioner No.2 assaulted by knife to the informant, causing head injury and petitioner No.3 snatched cash from the informant. It further appears that petitioner Nos. 1 and 2 are accused in other cases also.
Submission of learned counsel for the petitioners is
Patna High Court CR. MISC. No.73534 of 2019(2) dt.21-11-2019 2/3 that there is case and counter case between the parties and injuries are simple in nature.
Heard learned APP and learned counsel for the informant, who has opposed the prayer on the ground that petitioner No.1 is accused in six other cases and he has documents with respect to that.
In view of above facts and circumstances, let petitioner Nos. 2 and 3, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Araria, in connection with Tarabari P.S. Case No. 111 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
So far petitioner No.1 is concerned, learned court below shall verify the criminal antecedents of petitioner No.1 and if he is not accused in six other cases, as documents have been shown by learned counsel for the informant, he shall be released on bail to its own satisfaction, otherwise he has to pray
