Ms.Pushpa Sinha1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 18-01-2024 Heard Mr. Bela Singh, learned counsel appearing on behalf of the petitioner and Ms.Pushpa Sinha 1, learned APP for the State.

2. The petitioners are apprehending arrest in connection with Vaishali(Belsar O.P.) P.S. Case No. 493 of 2021 under sections 147, 148, 149, 341, 323, 353, 307, 504, 506 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution story, the informant alleged that one Virendra Rai used to threaten the opposite party, who is his villager and had damaged their house. On information, the police party had also seen accused persons assembled in the front of the house of Virendra Rai, who were pelting stones and had resorted to firing. They were identified by the 'Chowkidar'.

4. Learned counsel appearing on behalf of the petitioner submits that omnibus allegation is against the petitioner. Further, submission is that a coordinate bench of this Court has extended the co-accused the relief of anticipatory bail vide Cr. Misc. No. 61916 of 2022 on 24.01.2023.

Having considered the rival submissions made behalf of the parties, as well as, the nature of allegation, which is omnibus, the similar placed co-accused have since been extended the privilege of anticipatory bail, this Court is inclined to extend them the same relief of anticipatory bail. Let the petitioners be released on bail, in the event of their arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, in connection with Vaishali(Belsar O.P.) P.S. Case No. 493 of 2021 subject to the conditions as laid down under Section438(2) of the Cr.P.C.

6. The Court below is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in paragraph no. 3, this order will loose its force automatically.
