JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-04-2024 Petitioner is on provisional bail vide order dated 31.1.2024. He was granted time to marry the victim, against whom it is alleged that the petitioner committed rape.

2. Learned counsel for the informant has filed counter affidavit. It is stated that the petitioner has been granted provisional bail on his submission that the petitioner is ready to marry with victim the opp. party/Informant. Petitioner voluntarily agreed to marry with the informant which is supported with his averment in the petition. The Court considering his confession, granted provisional bail to the petitioner after his innocent submission before the court. On the other hand, order was passed on 31.01.2024 but till date there is no proposal on behalf of the petitioner in this matter. Though the

The informant herself talked with the petitioner through her mobile on 29 February but the petitioner did not reply positively. Conduct of the petitioner shows that he has committed fraud with the court for getting bail.

3. In view of the aforesaid development, provisional bail allowed to the petitioner is recalled. Petitioner is directed to surrender and seek regular bail.
