The petitioners seek bail in anticipation of their arrest in connection with Chaori P.S. Case No. 64 of 2018 dated 03.07.2018 instituted for the offences under Sections 147, 148, 149, 307, 341, 323 and 504 of the Indian Penal Code and under Section 27 of the Arms Act.
The petitioners and others are alleged to have made attempts to erect a hut on the land belonging to the informant. When it was protested, the informant was assaulted. Some of the accused persons are also said to have opened fire but hitting/injuring no one.
Patna High Court Cr.Misc. No.63874 of 2018(2) dt.12-12-2018 2/2 Learned counsel appearing for the petitioners has submitted that they are agnates of the informant and there is a long standing land dispute between them. A Title/Partition Suit No. 149 of 2018 is pending adjudication before competent court of law.
Regard being had to the aforesaid facts as also taking into account that nobody has been hurt in the occurrence and the petitioners have clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Bhojpur at Ara in connection with Chaori P.S. Case No. 64 of 2018 , subject to the conditions as laid down under Section 438(2) Cr.P.C.
