This application for anticipatory bail arises out of Mahila P.S. Case No. 8 of 2019, disclosing the offence under Sections 323, 341, 504, 354/34 of the Indian Penal Code. Petitioner is the brother of the informant's husband. From the FIR, it appears that the informant had lodged different criminal cases against her in-laws. In the present case, she has alleged maltreatment by her in-laws. It has been alleged that on 30.04.2019, the informant's mother-in-law, father-in-law and the petitioner assaulted the informant.
Learned counsel for the petitioner has submitted that for an occurrence said to have taken place on 30.04.2019, the FIR has been registered on 05.06.2019.
Patna High Court CR. MISC. No.83439 of 2019(3) dt.29-06-2020 2/2 Considering the nature of allegation made in the FIR, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Begusarai in Mahila P.S. Case No. 8 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
