2. The instant criminal writ application is being filed for issuance of direction upon the respondents to conduct fair and impartial investigation of FIR bearing Jagdishpur P.S. Case No.291/2024 registered for the offence under sections 103, 238, 61(2), 3(5) of the BNS 2023 and change the investigating officer as he is not investigating the case properly, fairly and impartially. Further prayer of the petitioner is to arrest the accused persons, who have not been arrested till date and further

Patna High Court CR. WJC No. 2412 of 2024(2) dt.17-06-2025 2/2 direct the learned Court below as well as police to make speedy trial of the case.

3. The F.I.R. has been filed on 25.08.2024 for murder and other offences. As the F.I.R. is being investigated, this Court will not interfere at such an early stage. The Police should also be given enough time to investigate a case as it is a case of murder.

4. In these circumstances, this application stands disposed of with liberty to the petitioner to approach the Magistrate concerned for redressal of his grievances in accordance with law laid down by the Hon'ble Supreme Court in the case of Sakiri Vasu v. State of U.P. reported as AIR 2008 SC 907.

5. If such an application is filed before the Magistrate, the Magistrate will act in accordance with law and will not keep the petition pending.
