ANJANA MISHRA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 15.10.2019, in connection with Gopalganj Town P.S. Case No. 523 of 2019 for the offenses under Sections 30(a), 41(1) of the Bihar Prohibition & Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from the Alto Car. The name of the petitioner has surfaced in the instant case merely on suspicion. It is further submitted that the petitioner has got a clean antecedent. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,
