JUSTICE SUDHIR SINGH ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case for the offence registered under Sections 341, 323, 307, 379, 354(B), 504 and 506 of the IPC.

The prosecution story, in brief, is that on 16.09.2019 while the informant was at her Beauty Parlour Shop, in the meantime, this petitioner having with Sword arrived there and made attempt upon the informant with intention to kill her, he also assaulted to her daughter. It has been alleged that the petitioner took out the golden chain from the neck of informant and also outraged her modesty.

Patna High Court CR. MISC. No.73467 of 2019(2) dt.18-11-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 23.09.2019. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Nature of injury is said to be simple and the said injury is on non-vital part of the body of the victim. Hence, no offence under Section 307 of the IPC is made out. Both parties are neighbourers and due to previous enmity there are number of litigation pending between them. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Katihar, in connection with Barari P.S. Case No. 296 of 2019, G.R. No. 4299 of 2019.
