Petitioner, who is in custody, seeks bail in connection with Excise Special Case No. 1068 of 2018 arising out of Jogbani P.S. Case No. 244 of 2018 registered for the offences punishable under Sections 30(a), 38(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation against petitioner is of recovery of 23.300 liters Nepali Country made liquor from his possession. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on the basis of suspicion. He is not named in FIR. Nothing has been recovered from the possession of the petitioner. He has no concern with the alleged

Patna High Court Cr.Misc. No.63938 of 2018(2) dt.29-10-2018 2/2 recovery. He has no criminal antecedent. He is in custody since 09.09.2018. It has been further submitted that similarly placed co-accused has been granted bail by this Court in Cr. Misc. No. 62971 of 2018 vide order dated 12.10.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Excise Special Case No. 1068 of 2018 arising out of Jogbani P.S. Case No. 244 of 2018.
