Petitioner seeks bail in Gaighat (Benibad OP) P.S. Case No.249 of 2017 instituted for the offence under Section(s) 395 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. There is no recovery from his possession. No Test Identification Parade has been held. Name of the petitioner has come in the confessional statement of Golu @ Ujjwal Kumar.

Petitioner is in custody since 21.04.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.65170 of 2018 (2) dt.02-11-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge 16th-cum-Additional Chief Judicial Magistrate, 15th, Muzaffarpur, in connection with Gaighat (Benibad OP) P.S. Case No.249 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
