Case No. 292 of 2019, arising out of N.D.P.S. Special Case No. 10 of 2019, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 214.860 litres of liquor from one WagonR vehicle and petitioner is named in the FIR, who succeeded in fleeing away.

Submission of learned counsel for the petitioner is that he is neither owner nor driver of the vehicle and he has been named only on suspicion and he is in custody for more than one and half months and charge sheet has been submitted in this case.

No.73733 of 2019(2) dt.25-11-2019 2/2 In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Sakra P.S. Case No. 292 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and he has to appear before the court as and when required and co-operate in disposal of the trial.
