JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 Petitioner prays for bail in connection with Shahkund (Sajour) P.S.Case No. 54 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation as per FIR is that on hearing sound of firing informant came and saw his wife dead and also saw the accused persons, including the petitioner fleeing away from the place of occurrence.
Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and petitioner has falsely been implicated in this case and he is in custody since 5.4.2018.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail of the petitioner
Patna High Court Cr.Misc. No.65360 of 2018(3) dt.26-11-2018 2/2 stating that case diary disclosed that petitioner has fired at the deceased, causing her death and there is also allegation against the petitioner is of demanding extortion.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
This application is, accordingly, dismissed.
