The petitioner seeks bail in S.Tr. No. 169 of 2018/ 344 of 2018, arising out of Nabinagar P.S. Case No. 113/2003, instituted for the offences under Sections 364, 302 and 34 of the Indian Penal Code read with Section 27 of Arms Act and Section 17 of C.L.A. Act.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. He has been remanded in this case on 16.03.2018. No T.I.P. has been held in this case. Other co-accused with similar allegation has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 27596/2011 dated 08.12.2011.

Patna High Court Cr.Misc. No.65134 of 2018 (2) dt.05-11-2018 2/2 Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IIIrd, Aurangabad in connection with S. Tr. No. 169 of 2018/ 344 of 2018, arising out of Nabinagar P.S. Case No. 113/2003, subject to the conditions that both the bailors shall be the close relative of the petitioner.
