JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Musrigharari P.S. Case No. 80 of 2018, registered for offences punishable under Sections 399, 402, 115, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. That the police on information that some persons have assemble and making preparation for commission of dacoity, on which, the police raided the house of one Dinesh Sharma, seeing the police, accused persons started fleeing away and in course of that petitioner and other accused persons were arrested and they were searched and from possession of the petitioner a mobile phone was recovered.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and no

Patna High Court Cr.Misc. No.65471 of 2018(2) dt.22-11-2018 2/2 incriminating article has been recovered from the possession of petitioner except a mobile, which belonged to the petitioner. Further petitioner has been in judicial custody since 24.06.2018 and although he is accused in three other cases but in all those cases, he is on bail.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Musrigharari P.S. Case No. 80 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
