JUSTICE SHIVAJI PANDEY ORAL ORDER 16-07-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual Court proceeding. In this case, the petitioners are seeking anticipatory bail in connection with Araria P.S. Case No.351 of 2019, registered for the offence under Sections 363 and 366A of the Indian Penal Code.

The daughter of the informant used to attend the Prince coaching centre near Kali Mandir, Araria. Allegation has been made against the petitioners to have kidnapped the

However, the girl has appeared before the Magistrate and stated that she was in love with Arshad @ Khaza, son of petitioner no.1 and brother of petitioner nos. 2 to 4, and has entered into the marriage with him. She further stated that there was no coercion of pressure to enter into the marriage. Looking to the aforesaid facts and circumstances of the case, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case no.351 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
