JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Agiaon Bazar P.S. Case No. 53 of 2015, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he has taken rupees 4 lacs from the informant for supply of bricks, but not supplied the same.

Submission of learned counsel for the petitioner is that earlier to that he has lodged a complaint case against the informant of this case that he has taken 20 thousand bricks and has not paid the money and thereafter this present case has been lodged against the petitioner and he is in judicial custody since 28.08.2018.

Heard learned A.P.P. also.

No.66831 of 2018(2) dt.26-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Agiaon Bazar P.S. Case No. 53 of 2015, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
