The petitioner is in custody since 25.07.2019 in connection with Guthni P.S. Case No. 117 of 2019 for the offence registered under Sections 30 (a), 38 (i) and 41 (i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is a driver and has nothing to do with any material which is transported in the vehicle, which he has been engaged to drive. It is further submitted that the alleged recoveries were not from his conscious possession.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing

Patna High Court CR. MISC. No.76313 of 2019(2) dt.29-11-2019 2/2 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge - 2nd cum Special Judge, Excise, Siwan in connection with Guthni P.S. Case No. 117 of 2019.
