The petitioner seeks bail in Excise Case No.
1431/2018, arising out of Shahpur P.S. Case No. 283/2018, instituted for the offences under Sections 30(a) and 41(1) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that the informant got confidential information that two person riding on motorcycle are going with illicit liquor. The police intercepted the motorcycle and apprehended those persons who disclosed their name as Deva Kumar Singh and Vikash Kumar Ojha @ Vikky Baba. It is alleged that total 288 pcs., each containing 180 ml. illicit liquor has been recovered from their possession. Thereafter another motorcycle
Patna High Court Cr.Misc. No.65167 of 2018 (2) dt.01-11-2018 2/2 came and police tried to stop. The accused wanted to run away but he was caught by the police and disclosed his name as petitioner. On search of his motorcycle, 76.500 ml. illicit liquor was recovered.
Learned counsel for the petitioner has submitted that petitioner is in custody since 09.09.2018. It is further submitted that earlier the petitioner was not involved in any other case of Excise Act.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhojpur, Ara in connection with Excise Case No. 1431/2018, arising out of Shahpur P.S. Case No. 283/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
