2. The petitioners in this application prays for grant of regular bail in connection with Madhaurah P.S. Case no. 439 of 2024 registered for the offence punishable under sections 25(1-A), 25(1-AA) 25(1-B)(a), 26 and 35 of the Arms Act.
3. As per the prosecution case, on secret
Patna High Court CR. MISC. No.1205 of 2025(03) dt.11-04-2025 2/3 information having been received, a raid was conducted on the premises of one Akhilesh Kumar Kushwaha. In the raid the main accused as also several other persons including the two petitioners herein were caught and large number of articles used in the manufacture of illegal arms were recovered.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. No incriminating articles have been recovered from their possession. They are in custody since 30.7.2024 and have no criminal antecedent. Their case stand on a similar footing to that of Md. Parwez who has been enlarged on bail vide order dated 6.2.2025 passed in Cr. Misc. no. 84114 of 2024.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioners in the F.I.R., their being in custody for 8 months since 30.7.2024, chargesheet having been submitted in the case and grant of bail to the above named coaccused, it is directed that both the petitioners above named, be released on bail in connection with Madhaurah P.S. Case no. 439 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand)
