Petitioners apprehend arrest in Complaint Case No 1220C of 2017 registered under Sections 120B, 420, 323, 504 of Indian Penal Code.

Learned counsel for the petitioners submits that the offence alleged are predominantly civil in nature. There is pending Title Suit between the parties with respect to the same lands which forms the genesis of the present case in Title Suit No 143 of 2016. Petitioners are having no criminal antecedent prior to the instant case.

Considering the aforesaid submissions and the fact

Patna High Court Cr.Misc. No.65619 of 2018(2) dt.13-12-2018 2/2 that the petitioners have no criminal antecedent, prayer for anticipatory bail is allowed. In the event of their arrest or surrender before the Court below within four weeks from today, the petitioners above named shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Jamui in Complaint Case No 1220C of 2017 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
