2. The petitioner seeks bail in connection with Ara Muffasil P.S. Case No. 6 of 2023 registered for the offence under Sections 147, 148, 149, 341, 323, 504, 506, 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioner has assaulted on the head of the deceased and the deceased died due to that.

4. The petitioner is in jail from 7.6.2023.

5. Learned counsel for the petitioner submits that initially the allegation of assault was against the petitioner but subsequently other accused persons are also said to have assaulted the deceased. One co-accused namely Samim and

Patna High Court CR. MISC. No.4540 of 2024(3) dt.21-03-2024 2/2 Samsad have been granted bail.

6. Considering the fact that the petitioner is the assailant of the deceased, this Court is not inclined to grant bail to the petitioner though some of the accused persons have been granted bail.

7. Accordingly, this application is dismissed.

8. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest. (Sandeep Kumar, J) Vikas/- U T
