2. Petitioner seeks regular bail in connection with Shampur P.S. Case No. 96/ 2024 dated 01.08.2024 registered for the offence(s) punishable under Section(s) 103(1) and 3(5) of the BNS, 2023.

3. The main submissions advanced by learned counsel for the petitioner are that in the FIR seven accused persons, including the petitioner, have been named but against this petitioner, there is no serious allegation and as per prosecution, she simply came with other accused persons and called the victim and except this there is no allegation against her and the main allegation of assaulting the deceased by using sharp edged weapon is against the co-accused, Pankaj Mandal, Badal Mandal and Bablu Mandal. No.83034 of 2024(2) dt.04-12-2024 2/2 petitioner is a young lady and she has been languishing in jail since 02.08.2024 and at the time of incident, she was of 7-8 months pregnant, so, the allegation levelled against her in the FIR is totally unbelievable, in fact, the deceased was a veteran criminal and 5-6 criminal cases were pending against him at the time of incident and against her, investigation has been completed.

4. Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the facts that the petitioner is a young lady and investigation against her has been completed as per above submission, and in the FIR, the main allegation is against co-accused, Pankaj Mandal, Badal Mandal and Bablu Mandal, in my opinion, it is a fit case for grant of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Shampur P.S. Case No. 96/ 2024 on furnishing bail bond of Rs.20,000/- (rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) BKS/- U T
