Petitioner in the present case is seeking regular bail in connection with Siswan (M.H. Nagar) P.S. Case No. 20/19 registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on suspicion. The petitioner is not named in the F.I.R. Learned counsel further submits that the petitioner was remanded in this case on the basis of self-confessional statement before the police. The petitioner is in custody since 14.03.2019 and charge-sheet has already been submitted in this case.

Patna High Court CR. MISC. No.73175 of 2019(2) dt.25-11-2019 2/2 Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case, where it is found from the records that in course of investigation police has recovered four stolen mobile sets and two stolen motorcycles from the possession of this petitioner and even the looted mobiles have been recovered from the possession of this petitioner, he has two cases of serious nature against him as stated in Paragraph '3' of the present application and if released on bail, is likely to cause terror in the society. I am not inclined to grant regular bail at this stage. Prayer is refused. (Rajeev Ranjan Prasad, J) vats/ved U T
