The petitioners apprehending are arrest in a case registered for the offences punishable under Sections 341, 323, 379, 354 and 504/34 of the Indian Penal Code. The prosecution case got initiated on the basis of written report submitted by Sunita Devi on 13.09.2017 to the Station House Officer of Shikarpur Police Station is to the effect that on the same day at 4.00 P.M., one Police Officer came and asked about address of the house of one Lalbabu Sah when the police officer returned from there, all the four accused persons including the petitioners came and started abusing the informant and slapped her. It is further alleged that petitioner no.2, Suraj
Patna High Court Cr.Misc. No.65269 of 2018(2) dt.13-12-2018 2/3 Kumar tore the blause of the informant, pushed the informant on the ground and thereafter, co-accused Rajmuni Devi snatched a gold ring and a mangalsutra from the informant. It is submitted by learned counsel for the petitioners that for a petty dispute, the accusation has been levelled against the petitioner and it is further submitted that the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP submits that the petitioners are named in the FIR.
Considering the nature of accusation and the fact that the investigation has already concluded, coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S.
