JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This is an application for grant of anticipatory bail in connection with Barauni P. S. Case No. 342 of 2019, disclosing offences under Sections 376, 504, 506, 341, 323, 34 of IPC. As per F.I.R. petitioner is said to have made physical relationship with the wife of the informant continuously and she informed about the same to her husband, who opposed the same, thereafter, accused persons assaulted her husband. Submission of the learned counsel for the petitioner is that she is married lady and major. The allegation disclosed that she was consenting party for the same.

Heard learned A.P.P. as well as learned counsel for the informant, who has appeared suo motu and submitted that they are threatening her to withdraw the case, in that connection, he

Patna High Court CR. MISC. No.73673 of 2019(2) dt.25-11-2019 2/2 has filed a case against this petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks, from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P. S. Case No. 342 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in disposal of the case and he will not threaten the informant or his family members, otherwise, they are at liberty to move for cancellation of his bail bonds before the learned court below itself.
