JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier petitioner was granted provisional anticipatory bail vide order dated 19.6.2018 in Cr.Misc.No. 20903 of 2018 on condition that he will deposit Rs.2 lakhs by way of Bank Draft in favour of informant and rest of amount of Rs.3 lakhs will be deposited in two equal instalments within a period of three months and on failure to deposit the amount, his bail bond shall be cancelled.
This application has been filed for modification of the said order on the ground that petitioner has already deposit Rs.2 lakhs and he could not appear because he had fallen ill and due to that he could not deposit rest of amount of Rs.3 lakhs. Submission of learned counsel for the petitioner is that he is ready to deposit the rest amount of Rs.3 lakhs in two
Patna High Court Cr.Misc. No.69559 of 2018(2) dt.12-12-2018 2/2 equal instalments in terms of direction of this Court. Heard learned APP also.
In such view of the matter, this application is disposed of with a direction to the petitioner to surrender within a period of four weeks from the receipt of this order and learned court below shall verify as to whether petitioner has deposited Rs.2 lakhs and if it is found so, petitioner shall be released on provisional bail with condition to deposit rest of the amount of Rs.3 lakhs in two equal instalments within two months from the date of his release, otherwise his bail bond shall be cancelled.
