2. The petitioner is in custody since 06.10.2023 in connection with Madhepura P.S. Case No. 273/2023 registered for the offence punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-B)A/26/35 of the Arms Act, Section 8/20(b)(ii)(A) of the NDPS Act and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the petitioner and others were caught for preparing for loot.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. The petitioner has no criminal

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 5th Cum Special Judge, Excise Act 1st , Madhepura in connection with Madhepura P.S. Case No. 273/2023.

7. The petitioner is directed to mark his attendance in Gamhariya police station Madhepura on 1st Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner.
