The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467 and 468 of the IPC.
The prosecution case as per the written report of Seema Rani, Circle Officer, Dehri submitted to the SHO, Dehri Town Police Station in view of the order of the District Magistrate is to the effect that the petitioner, who was Revenue Karmchari (now retired) scored through the name of Lalmuni Devi and incorporated the name of Manorma Devi without any order of the authority and issued rent receipt. Thereafter, the dispute arose and hence the petitioner recorded that since there is dispute with regard to land hence no receipt can be granted. It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.65323 of 2018(2) dt.13-12-2018 2/2 the petitioner is a retired government servant and after he came to know about the dispute with regard to the land in question he declined to issue any rent receipt.
Learned APP submits that without any order of the competent authority the petitioner deleted the name of original raiyat Lalmuni Devi and incorporated the name of Manorma Devi.
Considering the nature of accusation and the fact that any correction in Jamabandi is amenable to be challenged in a quasi-judicial proceeding, moreover, the petitioner is a retired government servant, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri in connection with Dehri (T) P.S. Case No. 594 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
