The petitioner seeks pre-arrest bail in connection with Buxar (Ind.) P.S. Case No. 111 of 2019 registered under Sections 25(1-B)a, 26 and 35 of the Arms Act and 30(a) of the Bihar Prohibition and Excise Act, 2016.

On receiving secret information about keeping liquor and arms in the house of Gopi Upadhayay, the informant, along with other police personnel, reached there and surrounded the house and apprehended Gopi Upadhayay from whom one country made pistol and from Dinesh Yadav one cartidge were recovered.

Submission is that the petitioner was not apprehended on the spot rather his name was disclosed by the co-accused. Petitioner has no criminal antecedent.

No.73066 of 2019(2) dt.19-11-2019 2/2 Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Buxar (Ind.) P.S. Case No. 111 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise Act, Buxar, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
