The petitioner, who is in custody, seeks bail in connection with Madhubani Town P.S. Case No. 353 of 2016 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code, under section 20 and 22 of NDPS Act, under Section 25(1-B), 9, 26 and 35 of the Arms Act and under Section 30(i), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.
Allegation against petitioner is of recovery of 53kg and 700 gm Ganja, one empty cartridge, one spring knife, 370 gm Charas, illicit liquor etc. from the house of accused persons. There is allegation against petitioner is of recovery of Narcotics Substance in huge quantity, as such, I am not inclined to enlarge the
Patna High Court Cr.Misc. No.72747 of 2018(2) dt.11-12-2018 2/2 petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
However, trial court is directed to expedite the trial and conclude the same within one year.
