The petitioner in the present case is seeking regular bail in connection with Shahpur P.S. Case No.268 of 2019 registered for the offence punishable under Section 376/34 of the Indian Penal Code and Section 67(A) of I.T. Act.

Learned counsel for the petitioner submits that the petitioner has not been identified in the video. On perusal of the FIR itself, this Court finds that the Chowkidar has identified three persons in the video and one of them is this petitioner who has been identified as the person involved in the commission of rape.

Considering the seriousness of the offence alleged and that the petitioner is in custody only since 10.07.2019, this Court is
