2. The petitioner is apprehending his arrest in connection with Dariyapur P.S. Case No. 259 of 2021 registered for the offence punishable under Section 393 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced
