Petitioner seeks regular bail in connection with Special Case No.7504 of 2019 arising out of Maner P.S. Case No.417 of 2019, for the offences punishable under Section 30(a)/37(c) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The allegation against the petitioner is that a total quantity of 20 litres of country-made illicit liquor has been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely been implicated in this case with oblique motive. Learned counsel further submits that seizure list was not prepared in accordance

Patna High Court CR. MISC. No.73848 of 2019(2) dt.11-12-2019 2/2 with law and procedure prescribed under Section 100 Cr.P.C. by the police at the time of seizure. Learned counsel for the petitioner further submits that the petitioner is in custody since 22.08.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 22.08.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Special Case No.7504 of 2019, arising out of Maner P.S. Case No.417 of 2019.
