The present petition has been filed for grant of regular bail on behalf of the petitioners in connection with Bodhgaya P.S. Case No. 349 of 2019 registered for the offence punishable under Section 379 of the Indian Penal Code.

The allegation is regarding the petitioners having been caught by the Police along with stolen tempo. The learned counsel for the petitioners submits that the petitioners are innocent and they are having clean antecedents and are languishing in custody since 16.08.2019. It is further submitted that the petitioners are ready to deposit

Patna High Court CR. MISC. No.75565 of 2019(2) dt.26-11-2019 2/2 cash security of Rs. 50,000/-.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the petitioners to deposit a sum of Rs. 50,000/- before the Nazarat of the learned Civil Court, Gaya and immediately upon deposit of the aforesaid sum, the petitioners, above named, shall be enlarged on regular bail subject to such conditions as may be imposed by the learned court below in connection with Bodhgaya P.S. Case No. 349 of 2019.
