Petitioner, who is in custody, seeks bail in connection with Sanokhar P.S. Case No. 136 of 2018 registered for the offences punishable under Section 188 of the Indian Penal Code and 30(c) of Bihar Prohibition and Excise (amendment) Act.

Informant who is a police officer has alleged that while vehicle checking petitioner who is driver of a tempo was apprehended when he was trying to flee away and on search recovered 55 kilogram Mahua and 4 tin of Gur total 60 kilogram which is used to make wine.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case.

Patna High Court Cr.Misc. No.68776 of 2018(2) dt.03-12-2018 2/2 He is a tempo driver and runs tempo from Ekchari Railway station to Mahgama Market. The alleged recovery belongs to the passenger who boarded on his tempo. He is in custody since 16.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Bhagalpur in connection with Sanokhar P.S. Case No. 136 of 2018.
