2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 420, 07 IPC and 138 NI Act the Indian Penal Code.
3. As per the prosecution case, in order to refund the loan amount petitioner handed over cheque of Rs. 10 lacs to opposite party no.2 but, the cheque was dishonoured due to insufficiency of fund in the back account.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner had already returned 1 lac Rs. On 6.2.2023. petitioner is ready to deposit Rs. 5 lacs in the court below in installments without prejudice to his case subject to the outcome of the criminal case. Petitioner claims clean

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1, Purnea in Complaint Case No. 3215 of 2015., subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure as well as, on the following conditions:
6. Petitioner would deposit total Rs. 5 lacs in the court below. 1 lac of which would be deposited at the time of furnishing bail bond. Rest 4 lacs would be deposited by him in 8 equal intallments within 2 years thereafter.
7. Deposits would be subject to the result of the criminal case.
