Petitioner, who is in custody, seeks bail in connection with Muffasil P.S. Case No. 220 of 2018 registered for the offences punishable under Sections 341, 342, 323, 324, 307, 354(B), 379, 504, 506/34 of the Indian Penal Code and under Section 3/4 of Dyane Act and Section 27 Arms Act. Informant has alleged that the F.I.R. named accused abused and assaulted informant and also took away cash and ornaments from the house. Allegation against the petitioner is taking away Rs. 35,000/- in cash and ornaments worth Rs. 01 lac from the house of informant and cloths valuing Rs. 15,000/-.
Patna High Court Cr.Misc. No.67898 of 2018(2) dt.27-11-2018 2/2 It has been submitted on behalf of the petitioner that there is land dispute between the parties and proceeding under Section 144 was decided in favour of petitioner. Petitioner has no criminal antecedent and he is in custody since 28.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Muffasil (Motihari) P.S.
