The petitioner seeks regular bail in connection with Bihta P.S. Case No. 643 of 2018, registered for offences punishable under Sections 379, 34 of the Indian Penal Code. Allegation against the petitioner is of theft of motorcycle which has later on recovered from the house of the petitioner.

Submission of learned counsel for the petitioner is that the house is joint house and the motorcycle has not been recovered from his conscious possession. Further submission is that the petitioner has no criminal antecedents and he is in judicial custody since 11.07.2018.

Patna High Court Cr.Misc. No.67132 of 2018(2) dt.27-11-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is disposed of with a direction to the concerned court below that once the charge is framed against the petitioner or petitioner completes six months period in judicial custody, whichever is earlier, he shall be released on bail by the concerned court below to his own satisfaction.
