Aslam Ansari, learned Additional Public Prosecutor for the State.

2. Petitioner seeks bail who is in custody since 22.06.2025 in connection with Hulasganj P.S. Case No. 58 of 2025, F.I.R. dated 06.03.2025 for the offences punishable under Sections 65(2), 352, 351(2) and 3(5) of the BNS, 2023 and Sections 4 and 6 of the POCSO Act.

3. According to prosecution case, this petitioner has committed rape upon the victim when she went to cut the grass in the field.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

The learned counsel for the informant as well as learned Additional Public Prosecutor have vehemently opposed the prayer for bail of the petitioner and submits that when the victim went to cut the grass in the field then in the meantime the petitioner caught her and committed rape upon her. Apart from that the statement of the victim was recorded under Section 183 of the BNSS, 2023 in which she has fully supported the case of the prosecution and the medical report also confirms the same.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Hulasganj P.S. Case No. 58 of 2025 pending in the court of learned Special Judge POCSO Act, Jehanabad.

7. Prayer is refused.
