JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Sour Bazar P.S. Case No. 387 of 2018 dated 08.07.2018 instituted for the offences under Sections 341, 323, 307, 385, 379, 504, 506, 34 of the Indian Penal Code.

The informant has alleged that while he was distributing foodgrains amongest the PDS beneficiaries, the petitioners and about 4-5 other persons came and asked for

Patna High Court Cr.Misc. No.69009 of 2018(2) dt.18-12-2018 2/3 paying up rupees fifty thousands as protection money. On refusal and protest by the informant, the informant was assaulted and personal belongings in the shape of cash was taken away by one of the accused persons.

The learned counsel for the petitioners has submitted that petitioner No. 1 had earlier preferred a complaint case against the informant of the present case and the wife of petitioner No. 2 had also filed a case against him. There is a delay of one day in lodging of this case and the parties are related to each other. Petitioner No. 1 and the father of the informant are own brothers and there is a pending land dispute between them. The injuries suffered by the informant are stated to be simple in nature. Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in
