2. This is the second attempt of the petitioner in connection with Rail Gaya P.S. Case No. 61 of 2023 registered for the offence under Sections 8/20(b), (ii)(B) of the NDPS Act.

3. As per the prosecution case, 10.650 KG of Ganja has been recovered from the possession of the petitioner.

4. The petitioner is in jail since 4.3.2023.

5. Learned counsel for the petitioner submits that the petitioner has no antecedent of similar nature, therefore, the petitioner deserve bail.

6. It has been submitted by the learned counsel for the petitioner that the trial of the petitioner is delayed and out of seven witnesses, one witness has been examined.

7. Learned APP for the State has vehemently opposed the application of the petitioner for grant of bail.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II, Gaya/concerned Court below in connection with Rail Gaya P.S. Case No. 61 of 2023.

10. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Kochas Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

11. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
