The petitioner seeks bail in Harlakhi P.S.Case No.191 of 2018 / G.R. No.1229/18 registered under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is of recovery of 102 litres Nepali wine from the motorcycle of the petitioner and he was arrested with that motorcycle.

Learned Counsel for the petitioner submits that the motorcycle does not below to the petitioner and he has been falsely implicated in this case. petitioner is in custody since 29.08.2018 having no criminal antecedent.

Learned A.P.P. opposed the prayer for bail of the petitioner.

No.67714 of 2018(2) dt.29-11-2018 2/2 Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge Excise Act Madhubani, in Harlakhi P.S.Case No.191/18 / G.R.No.1229/18 subject to the condition that bailors of the petitioner shall be of local having sufficient immovable properties within the jurisdiction of the court concerned.
