JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 447, 379, 511, 506 and 34 of the IPC and 27 of the Arms Act.
Although, petitioner is named in the first information report but specific allegation of making firing is against FIR named accused Rahul Kumar and it is only alleged that the petitioner was also present along with aforesaid co-accused Rahul Kumar. Moreover, para 3 of the petition goes to show that petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed. Accordingly, it is ordered that in the event of his

No.67453 of 2018(2) dt.04-12-2018 2/2 arrest/surrender within four weeks from the date of receipt of this order to the concerned court shall be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in Kishanpur P.S.
